3. Opting Out of SMS Services
You can cancel the SMS service at any time. Simply text “STOP” to the shortcode. Upon sending “STOP,” we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us. If you wish to rejoin, simply sign up as you did initially, and we will resume sending SMS messages to you.

5. Message Delivery and Carrier Liability
Carriers are not liable for delayed or undelivered messages. While we strive to ensure timely delivery of messages, certain factors outside our control, such as network availability or coverage, may cause delays or interruptions.
6. Message and Data Rates
As always, message and data rates may apply for messages sent to you from us and to us from you. Message frequency may vary. For questions about your text plan or data plan, please contact your wireless provider.

8. Intellectual Property
All content provided on our website, including text, images, graphics, logos, and other materials, is the property of Marly Media unless otherwise stated. You are not permitted to copy, distribute, or modify any content without prior written permission.
9. Limitation of Liability
By using our services, you agree that Marly Media and its affiliates will not be held liable for any direct, indirect, incidental, or consequential damages arising from the use of our services, including but not limited to SMS communications.
10. Term, Termination and Renewal
Standard marketing plans are month-to-month with no 12-month minimum commitment. The subscription renews automatically each month until canceled. To cancel, the client must send written notice at least 30 days in advance to info@marlymedia.com. Cancellation takes effect after the required notice period. Any terms specific to another service or a separately agreed custom scope must be disclosed and agreed before purchase.

We reserve the right to modify these Terms and Conditions at any time. Any changes will be posted on this page, and continued use of our services constitutes your acceptance of the updated terms.

13. Online Services and On-Site Production
Marly Media operates as an online agency serving businesses nationwide throughout the United States. Client meetings are usually held remotely through Google Meet. In-person meetings and on-site production visits may be arranged by appointment at the client’s business or another mutually agreed location.
The 50-mile service-area restriction applies only to included on-site production, not to the availability of our remote marketing services nationwide. Production days or sessions included in a marketing package are available only to local businesses within 50 miles of Miami, Florida. The production location must be confirmed with Marly Media before scheduling. The number and duration of included sessions remain subject to the purchased package.
Clients outside this service area should contact Marly Media before subscribing to discuss whether on-site production is feasible. Travel outside the service area is subject to availability and is not included in the package price. Any additional travel costs, production location, and schedule must be quoted separately and agreed in writing before travel is booked or production is scheduled. On-site production outside the service area is not guaranteed.
